Do I need a will?

Everyone should have an estate plan.  That could either be a Last Will and Testament or a Revocable Grantor Trust.  Without either one, the disposition of your assets is determined by state statute.  Often times, that is not how you would want your assets to be distributed.

What services do you provide for rental properties?

We can assist the Landlord with preparing a written lease.  We also advise Landlords of their options if a tenant becomes delinquent in rent or otherwise defaults under the terms of the rental agreement.  Ultimately, if necessary, we can handle the eviction proceedings.

How much does a will generally cost?

A Last Will and Testament should be tailored to the individual needs of each client.  A couple with minor children should have a Will which provides a Guardian for the minor children as well as a Trust for their care.  An older couple who has acquired substantial assets will want to consider estate planning provisions to limit estate taxes.  In any case, the cost of the Will is minimal to the cost of not having one.

Do you need a contract to sell real estate?

In Illinois, an agreement to buy or sell real estate is unenforceable unless it is in writing.  The Seller is also required by law to give certain disclosures before the Purchase Agreement is signed.  Our office can prepare all of the necessary documents as well as handle the closing.

How can I avoid going through the Probate process?

Whether you have a Last Will and Testament or not, it may still be necessary to probate a person’s estate.  Probate is the court monitored distribution of a decedent’s assets.  Depending how the decedent’s assets are titled, will generally determine whether probate is necessary or not.  There are options available which can reduce the likelihood that probate would be necessary, such as Transfer on Death Instruments, etc.

If a person has a Revocable Grantor Trust, and all assets are held within the Trust, probate can be avoided.  It is always best to talk with an attorney and determine what is best, based upon the individuals, estate and needs.
